“Majority of the Supreme Court Justices believed that the continued inclusion of the petitioners (Arroyos) in the watchlist order might probably work as injustice to them”, said by the Supreme Courts spokesman Atty. Jose Midas Marquez in a news briefing.

Three Conditions were given by the SC in the issuance of the TRO as they are required to post a cash bond of P2million pesos, they are also required to appoint a person who will receive subpoenas and other legal documents related to the ongoing investigation into the criminal charges against them. They were also ordered to inform the Philippine Embassies or Consulates in their chosen country at the time they arrived. Marquez said they had to impose such conditions because of the allegations that they are going to leave or flee, so the court has to put some measures to know where they are.
They were stopped at the NAIA gate1 from boarding their flight for Hong Kong on orders of Justice Secretary Leila de Lima. De Lima said that the Bureau of Immigration and the airport authorities are under orders to enforce the watchlist order until the courts decide on their motion
“I have ordered the Bureau of Immigration and requested the Secretary of Department of Transportation and Communication to direct the Civil Aviation Authority of the Philippines and NAIA management and personnel to exhaust all actions to implement the watch list order against the Arroyos” she said
“We have advised the National Bureau of Investigation and are advising the Philippine National Police and any appropriate law enforcement authority to be on the workout for the Arroyos attempt to immediately leave the country on the strength of the TRO” she said.
She expressed surprised at the SC’s issuance of the TRO ahead of the scheduled oral arguments on the watchlist order on Nov. 22 saying the TRO was a virtual decision on the case. The Justice Secretary also said she found it suspicious that the Arroyos were in a hurry to leave the country.
